Terms of Service
The terms under which BrettlJausn Pty Ltd provides the bikeryOS software platform to business customers such as bike shops and dealers.
Last updated: 2 November 2026
Parties and applicability
These terms govern the use of bikeryOS, a software-as-a-service platform for bike shops (point of sale, workshop, inventory, customer management and website builder), provided by BrettlJausn Pty Ltd (ACN 695 372 304, New South Wales, Australia) ("BrettlJausn", "we"). Contact: contact@brettljausn.ai.
bikeryOS is offered to businesses only (B2B). By registering you confirm that you act as an entrepreneur and not as a consumer.
Scope of services
We provide the modules and add-ons included in the plan you choose, as described on our platform and pricing pages. We may improve and change features, provided the agreed core functionality is not materially reduced.
Accounts and access
You are responsible for the accuracy of your registration data, for keeping credentials confidential and for all activity under your accounts and those of your staff. Please notify us without delay if you suspect unauthorised access.
Subscription, plans and billing
Plans, included modules and prices are shown on our pricing page, which forms part of these terms. Invoices are issued according to the selected plan and billing interval. Prices and billing details not shown there are to be agreed in writing. [Payment terms, VAT treatment and late-payment rules to be confirmed by legal counsel].
Customer data and data processing
You remain the owner of the data you enter into bikeryOS, including your customers' data. For personal data of your customers, you are the controller and we act as your processor; the details are set out in our privacy policy and in a data processing agreement (DPA) that we provide on request and that forms part of these terms. Each tenant's data is logically isolated from other tenants.
Your obligations
You will use bikeryOS lawfully and not misuse it, attack its security or resell it without permission. In particular:
- Fiscal and tax obligations, including cash register and RKSV requirements, remain with you as the shop. bikeryOS provides tools, but you are responsible for correct configuration and use.
- You are responsible for having a legal basis for processing your customers' data and for the content of messages you send.
- You must not send unlawful, misleading or unsolicited messages.
Third-party services
Some features rely on third-party providers, for example payment providers, Twilio (SMS and messaging) and Meta (WhatsApp Business Platform). When you connect such a service you enter into a direct agreement with that provider and accept its terms; we are not a party to it and are not responsible for the provider's services.
For WhatsApp, you must comply with the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy and, where applicable, the WhatsApp Commerce Policy, and you must obtain and document your customers' opt-in before sending them messages. Meta may restrict or suspend your WhatsApp access independently of us.
Availability and support
We aim for a reliable service and plan maintenance windows carefully. Unless a service level is agreed in writing, no specific availability figure is guaranteed. Support is provided as described for your plan. [Service levels, if any, to be confirmed by legal counsel].
Intellectual property and licence
bikeryOS, its software, designs and documentation remain our property or that of our licensors. During the term we grant you a non-exclusive, non-transferable right to use bikeryOS for your own business purposes. You grant us the rights necessary to process your data to provide the service.
Liability
To the extent permitted by law and as between businesses, we are liable only for intent and gross negligence; liability for slight negligence is excluded except for breach of essential contractual obligations, where it is limited to the foreseeable, typical damage. Liability for indirect damage and lost profit is excluded as far as legally permissible. [Exact wording and liability cap to be confirmed by legal counsel].
Term and termination
The agreement runs for the period of the selected plan and renews as stated there. Either party may terminate for good cause at any time. We may suspend access if you materially breach these terms or if payments remain overdue after a reminder. [Notice periods to be confirmed by legal counsel].
Data export and deletion after termination
After termination you can export your data for a reasonable period, which we will communicate. Afterwards we delete your data, except where the law requires retention (for example fiscal records, which are kept for the statutory period).
Changes to these terms
We may update these terms, for example due to new features or legal changes. We will announce material changes in advance in a suitable way. If you do not object within the stated period, the changes apply; you may terminate if you do not agree.
Governing law and venue
Governing law: [to be confirmed by legal counsel]. Place of jurisdiction: [to be confirmed by legal counsel]. Questions about these terms: contact@brettljausn.ai.
